Terms of Service

1. Agreement to These Terms
By subscribing to or using internet service from BreezeAir Networks LLC (“BreezeAir,” “we,” “us”), you (“Customer,” “you”) agree to these Terms of Service together with our Acceptable Use Policy, Network Management / Transparency Statement, and Privacy Policy, which are part of this agreement. If you don’t agree, please don’t use the service.
2. The Service
BreezeAir provides residential fixed broadband — Fiber Optic and Fixed Wireless internet — in select areas of East Tennessee. Service is month-to-month with no term contract and no data caps. Plans, speeds, and prices are described on our website and may change with notice.
3. Availability & Eligibility
Service is available only where our network reaches and, for Fixed Wireless, where there is a clear line of sight to one of our towers. Coverage maps are approximate; we confirm availability at your specific address before service begins (a free site survey for wireless). We may decline or discontinue service where it isn’t technically feasible.
4. Installation & Equipment
We provide professional installation at no charge. Equipment we provide (such as the wireless router, fiber enclosure, or antenna) remains the property of BreezeAir and must be returned in good condition when service ends. You agree to provide reasonable access for installation and to keep the equipment safe while it’s on your premises. Damaged or unreturned equipment may be billed at replacement cost.
5. Speeds & Performance
Advertised speeds are the typical (“up to”) speeds for each plan. Actual speeds vary with your devices, in-home wiring and Wi-Fi, network congestion, weather, and — for wireless — line-of-sight conditions. Service is provided on a best-effort basis; we do not guarantee a specific speed or uninterrupted, error-free service.
6. Billing & Payment
Service is billed monthly per our Billing & Repair Policy: invoices issue on the 1st and are due by the 19th. Late, missed, or returned payments may result in late fees, suspension, disconnection, a reconnection fee, and recovery/collection costs as described in that policy. Prices may change with advance notice.
7. Acceptable Use
Your use of the service is governed by our Acceptable Use Policy. You agree not to use the service unlawfully, to harm the network, to send spam, or otherwise in violation of that policy. We may suspend or terminate service for violations.
8. Customer Responsibilities
You are responsible for securing your own network and devices, for activity on your account, and for keeping your contact and payment information current. You agree not to resell or share the service beyond your household without our written consent.
9. Cancellation & Termination
Because service is month-to-month, you may cancel at any time; cancellation takes effect at the end of the current billing period, and any amounts owed remain due. We may suspend or terminate service for non-payment, violation of these Terms or the AUP, or where service is no longer technically feasible. Provided equipment must be returned upon termination.
10. Disclaimers
The service is provided “as is” and “as available.” To the fullest extent permitted by law, BreezeAir disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the fullest extent permitted by law, BreezeAir is not liable for indirect, incidental, special, or consequential damages, or for lost data, profits, or business. Our total liability for any claim will not exceed the amount you paid for service in the one month before the claim. The service is not designed to support emergency, medical, alarm, or other life-safety systems that depend on internet connectivity, and we are not responsible for their failure.
12. Indemnification
You agree to hold BreezeAir harmless from claims arising out of your use of the service or your violation of these Terms, the AUP, or any law or third-party right.
13. Privacy
Your information is handled according to our Privacy Policy.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on our website; continued use after the effective date means you accept the update.
15. Governing Law & Disputes
These Terms are governed by the laws of the State of Tennessee, and any dispute will be handled in the state or federal courts located in Blount County, Tennessee.
